Refers to all events excluding holidays, conducted by us; dinner events, other events.

Holiday
Refers to holidays promoted on the Site and any other promotional material.

Join
Refers to joining our database in order that you may receive news and offers from us about our holidays and related events.

Participant or Member or Guest or Traveller
Refers to any person taking part in a Holiday provided by us or any of our agents.

Privacy Policy
Refers to the Privacy Policy for collection, use and storage of personal information and is separate from these terms and conditions.

2.1     We aim to ensure that information contained on our site is correct, complete and accurate. We are not responsible for any inaccuracies or errors in content on our website or in any of our communications whether a result of human, technical or equipment errors.  Any information may change without notice.

2.2 Any complaint prior to an event or in relation to our service must be notified to us in writing or by email as soon as possible. Any complaint during an event must be brought to the attention of the restaurant as early as possible during your event and if not resolved to your satisfaction, should be notified to us in writing.

2.3 We do not guarantee and will not be liable in respect of any delays and failures in the provision of our service beyond our control. Without limiting, the following shall be regarded as such circumstances: act of God, outbreak of hostilities, riot, civil disturbance, acts of terrorism, revolution, the act of any government or authority, fire, flood, lightning, explosion, fog or bad weather, interruption or failure of a utility service, renovations undertaken by the restaurant, a restaurant closure after an event has been scheduled, strikes, lockouts or boycotts, embargo, blockade. In this respect refunds will not be given where we are not at fault.

2.4 You agree to indemnify Encounter Travel, its parents, affiliates, officers and employees against any liability and responsibility for any direct or indirect loss or damage including reasonable legal fees which are made by any third party, through relying on anything contained in or omitted from the site, content you submit to the Site, your use of the Service, unauthorised access to your data, inability to use the Site or your participation in any of our Services.

2.5 To the extent permitted by law you agree that Encounter Travel, its parents, affiliates, officers and employees shall not be liable for any direct losses (even if we have been advised of the possibility of such damages resulting from (i) the use or the inability to use the service (ii) the use of, or reliance on any information published on the site, (iii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services  (iv) unauthorised access to or alteration of your transmissions or data (v) any other matter relating to the service.

2.6 Use of our product or service is governed by New South Wales (NSW) law and is subject to the exclusive jurisdiction of the NSW courts. The booking confirmation and these terms represent the entire agreement between us and you.

2.7 Except as otherwise provided in these booking terms and conditions, your statutory rights are not affected.

2.8 Disputes arising out of or in connection with this contract which cannot be amicably settled may be referred to arbitration.

Each holiday has its own price and these details are provided on our website, promotional material we produce for the holiday and provided with a traveller quote at the time of booking.
